These Hire Terms govern the relationship between clients and freelancers when engaging in projects via SA Freelancers.
By hiring a freelancer through the platform, you agree to these terms.
If you do not accept these terms, you must refrain from placing orders or engaging freelancers through SA Freelancers.
When a client places an order with a freelancer, a binding agreement is created between the client and the freelancer.
SA Freelancers acts as a facilitator and provides the tools and platform to manage orders, payments, and deliveries.
The platform itself is not a party to the services or the contractual obligations of either party beyond facilitating the transaction.
Freelancers agree to provide services as specified in their service packages.
Deliverables must meet the agreed requirements, deadlines, and quality standards outlined in the package description.
Clients are responsible for providing accurate project details, necessary resources,
and clear instructions to enable the freelancer to complete the work efficiently.
All payments for services rendered on SA Freelancers are processed through the platform’s secure payment system.
The platform automatically deducts a 20% service fee from the total payment for its facilitation,
while the freelancer receives the remaining 80%. Payments must be completed in full before a freelancer begins work,
unless otherwise agreed through the platform’s workflow. Clients are responsible for timely payments,
and freelancers are responsible for delivering work only upon receipt of payment as per platform guidelines.
If a client cancels a project before the work is delivered, SA Freelancers charges a 8% cancellation fee.
If the client cancels after the project has been delivered, SA Freelancers retains 100% of the total project fee.
The 100% retained from post-delivery cancellations is split accordingly between the platform and the freelancer.
Cancellation requests must be made through the platform, and all parties should communicate clearly to ensure proper handling of refunds and payments.
Clients may request revisions according to the terms specified in the freelancer’s package.
Freelancers agree to provide revisions in good faith to meet the project requirements.
Once a client approves the work or accepts the deliverables, the order is considered complete.
Disputes about revisions should first be addressed through the platform’s messaging system and,
if necessary, escalated for mediation.
Upon full payment and completion of the order, all intellectual property rights in the delivered work are transferred to the client,
unless otherwise stated in the package description. Freelancers retain the right to use the work for portfolio purposes
unless explicitly restricted by the client. Both parties agree not to infringe upon the intellectual
property rights of others in the course of using the platform.
Freelancers must deliver work professionally, communicate clearly, and adhere to deadlines.
Clients must provide clear, truthful project instructions and make payments on time.
Any fraudulent, abusive, or illegal behaviour by either party is strictly prohibited and
may result in account suspension or termination. SA Freelancers reserves the right to investigate
complaints and enforce compliance with these Hire Terms.
SA Freelancers provides the platform to facilitate hiring and payments but is not liable for any loss,
damage, or disputes arising from the services rendered. Clients and freelancers agree
that any disagreements over quality, scope, or payment are their responsibility to resolve
through direct communication or platform dispute tools. The platform does not guarantee project outcomes.
In the event of a dispute, clients and freelancers must first attempt to resolve the matter through the
platform’s messaging system. If a resolution cannot be reached, the matter may
be escalated for mediation or reviewed under South African law. Both parties
agree to act in good faith during any dispute resolution process.
SA Freelancers reserves the right to update or modify these Hire Terms.
Users will be notified of material changes, and continued use of the platform after
updates constitutes acceptance of the revised terms. Users are encouraged to
review the Hire Terms periodically to stay informed of any changes.
These Hire Terms are governed by the laws of the Republic of South Africa.
Any legal proceedings arising from the engagement between clients and
freelancers shall be subject to the jurisdiction of South African courts.
